ACTUAL PROBLEMS OF ENSURING THE LEGALITY OF PROVIDING STATE AND MUNICIPAL SERVICES TO SOCIALLY VULNERABLE CATEGORIES OF CITIZENS BY MEANS OF PROSECUTION ACTIVITY
The article deals with problems arising in the provision of public and municipal services to socially vulnerable categories of citizens, including those related to the imperfection of the legislation (e.g. absence in the Code of administrative offences of the Russian Federation of the administrative responsibility for violating the procedure of providing municipal services), as well as in the application of administrative responsibility provided by article 5.63 of the Code of administrative offences of the Russian Federation. Based on the analysis of Russian legislation and law enforcement practice measures to improve the work of prosecutors in this area are proposed.

DECISIONS OF THE CONSTITUTIONAL COURT OF THE RUSSIAN FEDERATION AS A SOURCE OF CIVIL PROCEDURAL LAW
The article is devoted research of the legal nature of decisions of The Constitutional Court of the Russian Federation (hereinafter — CC RF), which he interprets the provisions of the Constitution or laws of the Russian Federation, and also decisions regarding the constitutionality of legislative acts. In the process of study of the subject, the author correlated the competence, the content and form of the activities of the authority of the constitutional control have the same characteristics of legislative acts. Giving the characteristic of the RF constitutional court, revealing his features, after a thorough analysis of its decisions, as well as taking recent research sources and publications on this issue, both domestic and foreign authors, judiciary practice and the civil procedure law, the author comes to the conclusion that the sources of law include only those decisions in which the constitutional court came to the conclusion that a particular law or normative act (partially or fully) does not meet the Constitution of the Russian Federation. Thus, according to the author, all decisions of the constitutional court, which he recognizes a particular norm of civil procedural law unconstitutional, are not only normative, but also are sources of civil procedural law.

CRIMINAL LIABILITY FOR FRAUD IN LENDING: PROBLEMS OF ENFORCEMENT
In article on the basis of the analysis of special literature and court practice considers the problems associated with the qualification of fraud in lending (article 159.1 of the criminal code), the delimitation of related offences.
The analysis of the application of article 159.1 of the criminal code of the Russian Federation revealed the ambiguity of approaches of researchers and legal professionals in matters of determination of legal concepts, objective and subjective signs of a crime, in separating it from adjoining structures. For example, this refers to the content of the concepts of «submission of knowingly false and (or) unreliable information», «money», «lending» or establish any guilty intent on stealing money, etc.
The greatest difficulties faced by the judicial practice, related with the necessity to determine the type of participation and qualification of actions of accomplices of a crime, including not possessing signs of the special subject. The authors believe that the definition of the word «borrower» in civil and criminal legal value do not match. Disposition of part 2 of article 159.1 of the criminal code provides the offence by the special entity (borrower) to a group of persons upon a preliminary collusion, goes beyond the common understanding of the doctrine of complicity. Meanwhile, the practice of applying art. 159.1 of the criminal code allows for qualification of actions of accomplices of a crime, including a special entity (the borrower), as committed by a group of persons upon a preliminary collusion. Obviously, this doctrinal complexity of the plan needed clarification of the Plenum of the Supreme Court of the Russian Federation.

In the article within the comparative analysis tendencies of functioning of the economic complex of a number of regions of the South of Russia in recent years are revealed. The potential of modernization of the economy of Stavropol Krai is presented. The influence of the organizational and administrative innovations on the activity and efficiency of use in practice of territorial management of institutes of economic development is shown.
Realization of the administrative capacity of bodies of the regional power of Stavropol Krai is mainly connected with the development of the production sector of the region. The article the main scientific approaches to determining the financial potential and factors of its formation; the definition of migration capital, the author analyses modern tendencies of movement. It is proved that the remittances of labour migrants have a significant impact on the formation of financial capacity as the host country and exporting countries of labor force. Listed on potential socio-economic threats, which may be due to excessive attraction of migration capital into donor countries of labor migration and its outflow from the donor countries, the migration of capital; the necessity of state regulation of migration processes.

DAILY DYNAMICS VOLUME AND PRICES OF OIL BRENT AND IMPACT ON FINANCIAL CAPACITY OF THREE FACTORS
According to the factual data Daily average price difference between the maximum and minimum price and sales volume given the laws of dynamics from 02.03.2007 to 02.24.2016 on the example of Brent crude oil. Additionally, take into account a new parameter in the form of financial capacity as the product of daily sales at the average price of oil. Because of the strong fluctuations in sales factor analysis was conducted on the highs of sales in the form of the envelope of the dynamic range of the line with the 02.03.2007 on 04.04.2016. It is possible to obtain statistical vysokoadekvatnye single-factor and three-factor model, which allowed to analyze the behavior of the world oil market in the past and show the ability to forecast with a decrease and stabilization of sales of oil. The article discusses some of the issues associated with the international practice of registration of foreign-yacht in the Black Sea ports of Russia. The development of nautical tourism in the Republic of the Crimea is given special attention. Russian Government is developing a program of creation of favorable conditions for development of yachting in the coastal areas of the Russian Federation. However, the legislation of the Russian Federation governing the yachts passing through the state border of the Russian Federation has not yet fully in line with international standards. Therefore, consideration of international practice, foreign-design yacht is relevant for the sustainable development of nautical tourism in the Crimea.

EFFECTS OF PRIVATIZATION TO IMPROVE FINANCIAL PERFORMANCE AND EFFICIENCY OF STATE ENTERPRISES IN IRAN
In accordance with Article 44 of the Constitution of the Islamic Republic of Iran, the Iranian economy is made up of three separate parts: state, cooperative and private. The public sector includes all major industries, mines, roads, rails and more. The cooperative sector includes cooperatives operating in the field of production and distribution. The private sector includes companies and private producers, industry, construction and other services and commercial activities in which the public sector and to co-operate. As a result, the private sector plays a very important role. The impact of privatization through economic analysis and statistical surveys. (The difference between before and after privatization). This study evaluated the effectiveness of privatization through the financial performance of companies privatized between 1999 to 2008 were tested. To achieve this, the number of 13 companies were selected that were privatized between 2007 and 2014. Then, about four dependent variables were studied. Privatization, as well as the independent variable were calculated. These studies were examined on the basis of a statistical method used to test hypotheses and annual financial statements. The results showed that privatization is the combined effect on the performance of the companies surveyed. The privatization program will also have a positive impact on the company’s financial performance, such as the EVA, operating cash flow and return on equity and return on investment does not affect the speed.
